Convictions for COVID-19 related non-compliance

The North Bay Parry Sound District Health Unit is reporting convictions have been returned against the owner of Stewart’s Decorating who was charged with COVID-19 related non-compliance in early 2021.

They relate to business operations under the Reopening Ontario Act and Health Protection and Promotion Act.

Officials say the Ontario Court of Justice entered convictions on all charges, totalling 36 corresponding offence dates, with the exception of two charges that were dismissed by the court.

The Health Unit says it continues to protect and promote public health under its provincial mandate, including progressive enforcement and prosecution of public health offences if necessary.

Here is the full statement from the Health Unit:

On Monday, June 3, 2024, the Ontario Court of Justice, North Bay Courthouse, rendered its decision concerning the Provincial Offence charges that were issued by the North Bay Parry Sound District Health Unit against Alexandra Stewart in relation to the business operations of Stewart’s Decorating between January and May of 2021 under both sections 10 of the Reopening Ontario (A Flexible Response to COVID-19) Act (the “ROA”) and section 100 of the Health Protection and Promotion Act (the “HPPA”). The charges were issued during this period in connection with observed non-compliance with COVID-19 regulatory requirements of the ROA in place at the time, and for non-compliance with a section 22 Order issued in accordance with the HPPA.

The Ontario Court of Justice entered convictions on all charges, totalling 36 corresponding offence dates, with the exception of two charges that were dismissed by the Court in its decision. The North Bay Parry Sound District Health Unit continues to protect and promote public health in accordance with its mandate under the provincial public health statutory regime, including conducting progressive enforcement and prosecution of public health offences if necessary.
