NBPS officer cleared by SIU after man suffers broken pelvis during 2016 arrest

A report from Special Investigations Unit Director Tony Loparco says it is clear that a North Bay Police officer acted with justifiable force in arresting a 29-year-old North Bay man in July 2016.

The man fled police during a domestic disturbance call and suffered a broken pelvis. Whether the injury resulted from the motor vehicle collision the suspect was involved in or from the officer pushing him against a garage door could not be determined. Loparco writes that the manner in which the arrest was carried out was lawful and that he is not convinced the injury resulted from the officer’s actions.

Loparco observes that the pursuit and apprehension of the man by officers was warranted. The man fled the scene in his boxers and operated a motor vehicle while having more than 80 milligrams of alcohol in his blood. He failed to remain at the scene of an accident and he was behaving recklessly when he exited his motor vehicle while it was still in motion.

Loparco also writes in his report that the subject officer used no more force than necessary in apprehending the suspect, adding that the man did not seem likely to give himself up. As such, Loparco finds that there are no grounds for proceeding with charges against the officer.
