Police Services act hearing against Officer to move forward

The North Bay Police Service will move forward with a disciplinary hearing under the Police Services Act against Officer Barry MacIntosh.

MacIntosh was found guilty of an assault charge yesterday. The Police Services Act charges were originally stayed, because the criminal charges took precedent. Police Chief Shawn Devine says there is now a 30 day appeal period for MacIntosh regarding the assault conviction, before further action will be taken.

After that, the next process would be the trial which is very similar to a criminal court. Except the lawyer in this case would be one hired by the board, and the hearing officer will likely be an officer out of Southern Ontario. Devine says it may be two months before the process for the hearing starts.

The verdict has some people up in arms, calling for MacIntosh to be fired among other things. Devine is aware of the outside commentary, including Amelia Rising putting forward a petition for MacIntosh’s firing. Devine says the board will look at that, but at the end of the day they have to go by the guidelines of the police services act.
